Agreement to Terms

By accessing our website or registering for or participating in any of our Workshops, you agree to these Terms and Conditions (“Terms”). If you do not agree, please discontinue use of our website and services.


Your participation constitutes acceptance of the most current Terms, including any updates published prior to final payment. We may update or revise these Terms from time to time to reflect operational, legal, or policy changes. The current version will always be posted on our website. Updated Terms will apply to all bookings made after the effective date, and to existing bookings only where changes are required by law or mutually agreed in writing. Your continued use of our website or participation in any workshop after the effective date of revised Terms constitutes acceptance of those changes.

Eligibility and Participant Conduct

You must be at least 21 years old to attend a Muench Workshop unless accompanied by a parent or legal guardian. By registering, you represent that you are physically and mentally fit for participation and understand that travel and photography activities involve inherent risks.

Participants agree to act respectfully toward staff, leaders, and fellow guests, and to follow reasonable instructions and local regulations. Muench Workshops reserves the right to refuse participation or remove any individual whose behavior disrupts the group or jeopardizes safety, without refund.

Tuition, Payments, and Refunds

Tuition, pricing adjustments, and refund terms follow those published on our website unless otherwise stated. Cancellation requests must be made in writing to [email protected]. Based on the cancellation date, the following apply (except in the case of Non-Refundable Workshops, as discussed below) :

  • More than 150 days before start date: full refund.
  • 150–91 days before: refund of all payments exceeding 50% of tuition.
  • 90–61 days before: refund of all payments exceeding 75% of tuition.
  • Within 60 days: no refund.

All refunds are issued by the same payment method and are subject to a 5% administrative processing fee.

Non-Refundable Workshops. Some workshops are designated as non-refundable, meaning that the cancellation terms above do not apply and no refunds of any payments will be issued under any circumstances. For these workshops we strongly recommend comprehensive trip insurance (cancel for any reason). These workshops will always be clearly identified in their online description with the notice: “Payments for this workshop are non-refundable under any circumstances; our other Terms and Conditions apply.”

If the workshop sells out. No matter when you cancel, for both refundable and non-refundable workshops, if all of the originally offered spaces are filled, you will receive a full refund to the original payment method, minus a 5% administrative processing fee. Payments for private workshops are never refundable.

Pricing Adjustments. To maintain service quality and access, Muench Workshops may, in limited circumstances, apply additional charges or modest adjustments to the workshop price between the deposit and final payment. Potential adjustments and pass-through charges may include, but are not limited to:

  • Fuel surcharges. If transportation or logistics costs materially increase due to fuel-price volatility, a surcharge may be applied.
  • Currency fluctuations (international). Where third-party services are priced in foreign currencies, the workshop price may be adjusted to reflect significant exchange-rate movements prior to final payment.
  • Supplier or lodging changes. If contracted providers (e.g., charter aircraft, accommodations, private vehicles, etc.) change their rates or required services, a corresponding adjustment may apply.
  • Unexpected logistics or transfers. If alternate or additional transportation is required to operate the itinerary safely and effectively—such as alternate drop-offs or repositioning vehicles, boats, or aircraft—those costs will be billed at cost.

Payment Authorization. By submitting payment information, you authorize Muench Workshops to charge the amounts due for deposits, tuition, and authorized adjustments. You agree not to initiate a chargeback or reversal with your credit-card provider without first giving Muench Workshops written notice and an opportunity to resolve the issue. Unauthorized chargebacks constitute breach of contract, and you agree to reimburse Muench Workshops for any resulting costs, fees, or losses, including reasonable attorneys’ fees.

Cancellation or Change of a Workshop

While Muench Workshops, LLC will make every reasonable effort to operate a workshop once confirmed, we reserve the right to cancel at any time due to insufficient bookings, logistical complications, or circumstances beyond our control that might create unsafe or undesirable travel conditions for participants.
 
If we must cancel, a full refund of amounts paid directly to Muench Workshops will be issued. Our financial liability is strictly limited to the amount paid to Muench Workshops for the workshop itself and will not extend to any additional expenses incurred by participants, including but not limited to: non-refundable airfare, visa fees, clothing or equipment purchases, transportation costs, medical expenses, or travel-insurance premiums.
 
We also reserve the right to refuse acceptance of any participant, for any reason, at any time, and are not responsible for any additional costs incurred by such participant.
 
For workshops outside the United States, tuition may be adjusted after you have registered if local currency fluctuations, supplier rate changes, or government taxes materially affect our costs.
 
In the event that Muench Workshops is prevented from performing its obligations by events beyond its reasonable control — including acts of war, terrorism, civil unrest, strikes, pandemics, epidemics, government orders, travel restrictions, natural disasters, or other causes — Muench Workshops shall not be deemed in breach of contract. In such cases, we may reschedule, postpone, or apply payments as credit toward a future workshop. No further refunds, reimbursements, or compensation will be payable.
 
Muench Workshops reserves the right, in its sole discretion, to reschedule, postpone, or apply payments as credit toward a future workshop. Participants shall bear all additional costs resulting from such changes, including, but not limited to, airfare, visas, insurance, or other personal expenses. Muench Workshops will use reasonable efforts to mitigate the effects of such events, but shall have no further liability to any participant arising from delay, cancellation, or modification of services.

Health, Fitness, and Participant Warranties

You are solely responsible for selecting a workshop or activity appropriate to your physical abilities and interests and for ensuring that you are in sufficiently good health to undertake it. By registering and submitting your deposit, you certify that you do not knowingly have any medical condition, disability, or other consideration that would create a risk for yourself or for other participants.

You authorize Muench Workshops and its workshop leaders or guides to initiate and offer emergency medical care in the event of illness or injury when immediate treatment is, in their judgment, advisable. You agree to assume all costs of such medical care and related transportation.

Muench Workshops reserves the right to request a physician’s statement of good health at any time. If, after reasonable accommodations of your physical abilities have been made, the workshop leader determines that your continued participation would adversely affect the group’s activities or safety, you may be removed from the workshop. Any expenses related to your removal or early departure are your sole responsibility.

We also reserve the right to reassess your fitness for participation based on any new information you provide before the workshop and to make final determinations in the interest of group safety and experience.

You are solely responsible for all costs of emergency evacuation, rescue, or medical care arising from illness or injury during a workshop, whether arranged by Muench Workshops or third parties. We often require participants to have evacuation insurance, and if it is not a requirement, we strongly recommend purchasing travel and evacuation insurance that covers these and related expenses. You release Muench Workshops from any liability for the adequacy, timeliness, or cost of any such services.

Liability and Assumption of Risk

By attending any Muench Workshop, you acknowledge and accept that travel and photography activities inherently involve risk. Your application and payment serve as a release of liability and a complete assumption of all risks by you and your heirs, administrators, executors, successors, and assigns, on behalf of yourself and all family members.

By accepting these Terms, you acknowledge that travel, wherever it may occur and by whatever means, involves potential hazards including injury, illness, death, loss, or damage to personal property, which may be caused by acts of nature, negligence, or the actions of others.

In consideration of, and as part of payment for your participation in any workshop, program, expedition, excursion, or other activity conducted by Muench Workshops, LLC or its affiliates, you voluntarily release and hold harmless Muench Workshops, LLC, its officers, employees, assigns, independent contractors, agents, sponsors, and partners from any and all damages, liabilities, costs, injuries—whether mental or physical, known or unknown—arising out of or related to participation in such activities. By joining a workshop, you agree to assume all risks, known or unknown.

You further acknowledge that workshops may involve travel to remote, foreign, mountainous, wilderness, or otherwise undeveloped areas that may not meet the safety, sanitation, or comfort standards to which you are accustomed. These environments may involve additional dangers and inconveniences, including but not limited to: terrorism, forces of nature, wild animals, unpredictable weather, hotel or transportation failures, airplane, vehicle, train, or boat incidents, rough roads, walkways, or trails, and other unforeseen hazards.

You understand that medical services and facilities may not be readily available at all times or locations, and that emergency medical evacuation may be difficult or delayed. Muench Workshops assumes no responsibility for medical care or expenses, and no liability for dietary needs or allergies.

Except in cases of gross negligence or willful misconduct, you agree that Muench Workshops, LLC, its affiliates, and representatives shall not be held liable for any loss, injury, death, damage, or expense arising from participation in a workshop or related travel.

Limitation of Liability. The total liability of Muench Workshops, whether in contract, tort, or otherwise, shall not exceed the lesser of (a) USD $5,000 or (b) the total amount paid by the participant for the workshop. Muench Workshops shall not be liable for any indirect, incidental, or consequential damages of any kind.

Independent Contractors. Workshop leaders, guides, and instructors engaged by Muench Workshops may be employees or independent contractors. Muench Workshops shall not be liable for their acts or omissions except to the extent required by applicable law, and nothing in this Agreement shall limit liability for the company’s gross negligence or willful misconduct.

Participant Responsibilities

You are responsible for reviewing all pre-workshop materials, bringing the required equipment and appropriate clothing, and maintaining respectful conduct toward fellow participants, staff, guides, and the locations we visit.

Group Travel and Flexibility. You acknowledge that travel with a group inevitably involves compromise to accommodate the diverse goals, interests, personalities, and physical abilities of other participants. While our itineraries are carefully planned, they are intended as examples and guidelines rather than guaranteed schedules of specific activities, locations, or events.

Changes may occur at any time due to geographic, climatic, physical, governmental, or other conditions beyond our control. Program leaders and professional guides have full discretion to make adjustments as they deem necessary for the safety, comfort, or overall experience of the group. You agree that such changes do not constitute grounds for refunds or discounts, even if certain activities are curtailed or modified.

You are responsible for studying all pre-workshop information, bringing required gear and personal items, and maintaining appropriate dress, hygiene, and consideration toward fellow participants, staff, and local environments.

If you choose double-occupancy lodging and we are unable to match you with a roommate, you may be charged the single-supplement fee listed for that workshop.

Muench Workshops reserves the right to cancel any activity, or to accept or reject any participant, at any time. The workshop leader’s judgment shall be the final determination of a participant’s ability to continue in any workshop or activity.

Equipment Responsibility. You are responsible for the care, safety, and insurance of your personal photography equipment. Muench Workshops is not responsible for loss, theft, or damage to any personal gear. If you borrow, rent, or use Muench Workshops or third-party equipment, you accept it “as is” and assume full responsibility for its use and any resulting damage or injury. Participants are solely responsible for ensuring that any photographic or video equipment they use complies with all applicable laws and regulations, including local restrictions on unmanned aerial systems (drones). Drone use may be prohibited or restricted in certain parks, wildlife areas, or foreign jurisdictions. Participants must obtain all required permits and operate drones safely, respectfully, and in compliance with local regulations. Muench Workshops may limit or prohibit drone use at its discretion for safety, privacy, or logistical reasons. Violations may result in removal from the workshop without refund.

Environmental and Cultural Respect. Participants agree to follow Leave-No-Trace principles and to respect wildlife, ecosystems, and local communities. This includes refraining from disturbing animals, damaging vegetation, littering, trespassing on restricted lands, or violating cultural norms. Participants must also follow all site-specific photography rules, including any restrictions on flash, tripods, or drone use. Muench Workshops reserves the right to remove, without refund, any participant whose behavior negatively impacts the environment, local communities, or the experience of others.

Promotional Items. You may receive complimentary promotional items such as apparel or photo accessories. Use of these items is entirely optional, and you assume all risk and responsibility arising from their use.

Instructor Restriction; Confidentiality and Non-Solicitation

If you are a photographic instructor, guide, or tour leader, you must disclose that status when booking. All itineraries, workshop materials, lesson plans, client lists, vendor contacts, and other proprietary information provided or observed during a Muench Workshop are confidential and the intellectual property of Muench Workshops, LLC (“Proprietary Information”). You agree not to reproduce, disclose, or use such Proprietary Information for any commercial or competitive purpose, including organizing or promoting a substantially similar photo tour, without the prior written consent of Muench Workshops.

You further agree not to solicit, contact, or market services to any participant, partner, or vendor met through a Muench Workshop for commercial purposes for a period of three (3) years after the workshop.

This restriction includes, but is not limited to, the use or replication of Muench Workshops’ itineraries, teaching materials, photographic techniques, operational methods, or customer information for the purpose of offering or marketing any photography-related instruction, tour, or guiding service. 

During a Muench Workshops event, participants may learn the identities and contact details of other guests, contractors, or partners. This information is part of Muench Workshops’ confidential customer and supplier network and is provided solely to support the group experience. Participants may retain contact details that are expressly and directly shared with them by another participant for personal, non-commercial social purposes (e.g., staying in touch as friends), subject to that person’s privacy preferences. Participants may not copy, compile, harvest, or otherwise collect contact details from rosters, group emails, messaging apps, or any distribution lists; may not use any such information for business, marketing, instructional, or guiding purposes; and may not contact or solicit others for any commercial or competing venture before, during, or after the event. If any participant asks not to be contacted, you must respect that request.

In the event of a breach of this section, the parties agree that the damages to Muench Workshops would be difficult to determine with precision, and that liquidated damages of USD $45,000 per occurrence represent a reasonable pre-estimate of such loss and are not a penalty. This provision is in addition to any other remedies available at law or in equity, including injunctive relief.

Personal, non-commercial contact among participants is, of course, permitted with mutual consent.

The obligations in this Section survive completion of the workshop.

Use of Name, Likeness, and Materials

Muench Workshops, LLC reserves the right to photograph, film, or otherwise record any workshop or portion thereof, including participants, locations, and activities, and to use the resulting imagery or recordings, in whole or in part, for promotional, educational, or archival purposes. Such uses may include, without limitation, advertising, publicity, website and social-media content, printed materials, and other media now known or later developed.

By booking a reservation with Muench Workshops, you grant Muench Workshops, LLC and its affiliates permission to use your image, likeness, voice, and any written, photographic, or behind-the-scenes contributions you choose to share with us for lawful promotional, educational, or archival purposes, in any media now known or later developed. You always retain full ownership and copyright in the photographs and creative work you produce during a workshop. We’ll never sell or license your images to others without your written permission, and we’ll give credit wherever reasonably possible. By participating, you agree that Muench Workshops may use this material without needing further approval from you each time.

Participants who prefer not to be photographed or recorded must notify their tour leader in writing at the start of the workshop, and Muench Workshops will make reasonable efforts to honor such requests.

This consent survives completion of the workshop and applies to all derivative works, edits, and excerpts that may be created from the original materials.

Use of Website and Intellectual Property

All website content, including text, images, videos, and logos, is owned or licensed by Muench Workshops and protected by law. You may view content for personal, non-commercial purposes only. Reproduction without written permission is prohibited.

All materials shared during workshops are proprietary and may not be used for any commercial purpose without written consent.

Third-Party Services

You understand that Muench Workshops relies upon independent third-party service providers—including but not limited to tour organizers, transportation providers, hotel operators, and food vendors—to furnish many of the services associated with its workshops. All tickets, reservations, coupons, and arrangements are subject to the terms and conditions and operational policies of those third-party providers.

Muench Workshops cannot control the actions of such third parties and assumes no responsibility for unanticipated events or circumstances beyond its control, including, without limitation, travel delays, lost luggage, cancellations, overbooking, scheduling errors, or other irregularities.

Participants should build flexibility into their travel plans in case it becomes necessary to extend the length of a workshop or make other reasonable scheduling changes to accommodate such events. You agree that you are not entitled to a refund, discount, or compensation in connection with such unanticipated scheduling adjustments.

You further agree to release, defend, and hold harmless Muench Workshops, LLC, its owners, officers, employees, contractors, and agents from any liability for injury, death, loss, damage, delay, or irregularity arising from or in connection with any services provided by third parties.

Insurance

Unless you are already covered under an existing policy, we strongly recommend that you purchase comprehensive travel insurance to protect your investment. Such coverage typically provides reimbursement or benefits in the event of workshop cancellation or interruption, travel delay, lost or delayed baggage, loss of travel documents, medical emergencies, or accidental death.

When traveling outside of your home country, we strongly recommend separate travel medical insurance that specifically covers emergency medical treatment, evacuation, and hospitalization while abroad.

Muench Workshops assumes no responsibility for losses, damages, or expenses that could have been covered by travel insurance. It is your responsibility to verify the adequacy of your coverage and to understand your policy’s terms, including exclusions for preexisting conditions or adventure-related activities.

Costs Not Included

Unless specifically noted in the workshop itinerary, tuition fees do not include:

  • Air transportation and related fees;
  • Activities or excursions noted as optional;
  • Passport and visa expenses;
  • Baggage, accident, or cancellation insurance;
  • Personal expenses, such as laundry, telephone calls, and alcoholic beverages;
  • Meals not listed as included in the itinerary; and
  • Any other items not expressly described as included.

Participants are solely responsible for these and any other incidental costs incurred during travel.

Travel Documentation and Entry Requirements

You are solely responsible for ensuring that you possess all required travel documents, visas, and immunizations necessary to participate in the workshop and to enter, exit, or transit through any destination country.

We strongly recommend that you check with the relevant consulate(s) or visa agency well in advance of travel to confirm current entry and vaccination requirements. A valid passport is required for all international travel, and your passport should remain valid for at least six (6) months beyond your planned return date.

Muench Workshops assumes no responsibility for denied entry, travel interruptions, or additional expenses resulting from incomplete or inaccurate travel documentation.

Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of California, U.S.A., without regard to its conflict-of-law principles. This choice of law applies to all participants, regardless of place of residence or participation.

All claims and disputes arising under or relating to these Terms must be brought on an individual basis. Class, collective, or representative actions are expressly waived.

Arbitration shall be the exclusive means of resolving any dispute arising under or relating to these Terms, except that either party may seek temporary injunctive relief in a court of competent jurisdiction to protect intellectual property or confidential information.

Arbitration will be conducted under the rules and procedures of the American Arbitration Association (AAA). Unless otherwise agreed, the arbitration shall take place in Santa Barbara, California, or remotely by video conference or other mutually agreed means, eliminating any requirement for participants to appear in California in person.

Any arbitration award may be entered as a judgment in any court of competent jurisdiction.

If a party refuses to submit to arbitration after agreeing to this provision, the other party may compel arbitration under the authority of the California Code of Civil Procedure and applicable federal law.

Severability and Assignment

If any provision in these Terms is found unenforceable, the remaining provisions remain in effect. Muench Workshops may assign its rights and obligations under these Terms to an affiliated entity.

Updates

We may update these Terms periodically. Continued use of our website or participation in workshops after updates constitutes acceptance.
